What you need to know about drug dealing and selling charges

If you’re dealing with charges related to selling or dealing drugs in New York, the penalties are often severe. Simple possession, which doesn’t involve intent to distribute the substance, might only lead to misdemeanor charges. But when you’ve sold or dealt drugs – or even just had the intention to – the classification of the crime might increase to that of a felony.

Some attempts have been made to bring down these penalties for selling or attempting to sell drugs. But it’s still important to be careful because marijuana remains a Schedule I controlled substance in the eyes of the federal government. This creates the danger of getting mixed up in harsh drug dealing charges.

What determines the severity of charges?

The key factors that play into how drug charges are penalized are the illegal substance that was involved, how much was sold, and whether the perpetrator was guilty of any previous crimes.

It’s important to realize that even though selling drugs may be the last thing on your mind, if you have enough of certain substances, that’s the presumption that can legally be made.

The amount of controlled substance that the individual is caught with plays a major role in the severity of the charges. Compared to drug trafficking charges, there are greater limitations placed on drug dealing.
